Question
Imaan owns a small boutique, Hatters City, selling clothes that she designs to the public. Recently she was selected to present her designs at a local fashion show, which she had to submit for approval no later than 19th January.
Imaan travelled to London to a well-known clothing warehouse, Tarrods for fabric and other goods. Upon arriving, Imaan was greeted by the manager, Ateeq. Imaan informed Ateeq of the fashion show and asked him for twenty metres of white silk, 10 metres of green silk and 4 metres of black silk. She asked Ateeq to cut the white silk into 4 equal pieces and the green silk into two equal pieces.
Next, Imaan chose a sewing machine for £300. Ateeq informed her that it was discounted as it was an ex-display model however, it worked well and ‘had no problems.’ Imaan was happy to purchase it as the same one was being sold online for over £1000.
Imaan asked Ateeq to recommend sewing needles that were long lasting as she would be working with heavily embroidered material. Ateeq recommended the Sharp brand needles. At first Imaan was unsure as she had heard bad reviews of the brand. Ateeq dismissed her concerns and told her that ‘these are the best needles on the market.’ Imaan purchased two packets and left the warehouse with her goods.
The next day Imaan started on her designs. When she opened the bag with the silk, she noticed that the white silk has been cut into two pieces and the black silk into four. Imaan then switched on her sewing machine and inserted a new needle. She decided to trial the needles on heavily embroidered material and to her horror, the needle snapped into two. This happened twice before she inserted her old needles. Unhappy and frustrated at the goods she purchased; Imaan decided to create a blouse instead with the silk to avoid the material going to waste. As she switched on the sewing machine again, sparks flew from the socket followed by a bang and a strong smell of burning. The sewing machine then stopped working.
Imaan called Ateeq at Tarrods to complain of the goods. Ateeq sympathised with her however, stated that the sewing machine was ex-display ‘so what can you expect?’ and that the incorrectly cut silk was ‘probably a mistake, just make something else out of it.’ Imaan is angry at the lack of concern shown by Ateeq and approaches you, a trainee solicitor, for advice.
Advise Imaan of her rights and remedies under the Sale of Goods Act 1979. You must refer to relevant case law, legislation and academic sources.

- You must upload a written bibliography, stating the case law, legislation and any other sources you have used, on canvas. Please also copy the sharable link to your Youtube video on the bibliography word document. Submit your bibliography as a word document on canvas. Bibliography must be OSCOLA compliant.
