Question:
Marine Advancer Ltd enter into a contract with Quality Shippers Ltd for the carriage of 30 sports cars, 20 Yamaha R -1 motorbikes and 1000 litters octane. The goods were carried on The Atlantic from Madrid to London in December 2024. The contract was covered by a bill of lading that provided English law would apply in the event of a dispute and that the carriers were free to carry goods on deck, with no liability for the ship owners. 20 Yamaha R-1 motorbikes were carried on deck and the rest of the goods below deck.
On a previous voyage The Atlantic was set on fire and suffered extensive damage. Marine Advancer Ltd instructed an independent firm of ship repairers to carry out the repairs before the voyage. They ensured the ship repairers gave them the go ahead before commencing the voyage.
Halfway through the voyage, The Atlantic lost its balance due to bad weather, and poor stowing techniques in cargo management led to 18 Yamaha R-1 motorbikes being washed overboard. Later that day, Captain Jack received the heart-breaking news that his beloved pet dog, Lilly, had died in an accident. Lilly was very special to him, and Jack had spent much of his free time with her. Overcome with grief, Jack turned to alcohol to cope and asked his assistant, Sunny, to take control of the ship. The Atlantic then deviated from its route, stopping in Belfast as Jack required urgent medical attention for alcohol poisoning. On the return journey from Belfast, Sunny fell asleep, causing the ship to accidentally collide with another vessel, resulting in significant damage to 10 sports cars.
A faulty pump in The Atlantic allowed water to seep through the cargo holding the 1000 litres of octane, resulting in it now being of sub-standard quality. When The Atlantic arrived in London, an inspection revealed that the interiors of 20 sports cars stored in cargo hold 4 were damaged by seawater, which had entered the hold through faulty storm valve covers. This occurred because an independent firm of ship repairers had failed to follow instructions to fix the covers.
Critically evaluate the liability of the carrier and shipper under the Hague-Visby Rules. Would your answer differ if 1000 litres of octane were carried on deck under the Hamburg Rules?
